Both parties can seek damages in all cases of job termination
A worker who assaults his employer can be immediately sacked as this act violates the UAE labour law, according to the Ministry of Labour.
In other cases, the employer and worker can end the job contract as per a mutual agreement, provided they are served with a notice of at least one month and maximum three months, a ministry official said, quoted by Emarat Alyoum daily.
The unnamed official said either party can also end the job contract without notifying the other but this would incur legal action.
“There are four cases for ending the unlimited job contract…one case allows the employer to sack his employee when the latter violates Article 120 of the labour law…this may include assaulting the employer,” the official said.
“In all cases, either party can resort to court to seek damages and other rights specified by the law that regulates the relationship between the employer and the employee.”
As for the limited job contracts of up to two years, the two parties can end the contract as per a mutual agreement , the official said.
In another case, either party can end the contract with a written notification provided the affected party is served with a notice of a minimum one month and maximum three months. During this period, the employer must pay all dues to the worker provided they do not exceed three-month salary.
